General Terms and Conditions (GTC)
for the rental of vacation apartments at Das Lisa'l – Apartments, Zell am Ziller
1. Scope of Application
These GTC apply to all contracts for the rental of vacation apartments (Das Lisa'l Chalet-Loft and Das Lisa'l City Loft) at Dorfplatz 10, 6280 Zell am Ziller, Austria, by Helmut & Christiane Seitz (hereinafter “Landlord”) to the guest (hereinafter “Tenant”).
2. Conclusion of Contract and Booking
2.1 The presentation of the vacation apartments on the website does not constitute a binding offer, but an invitation to submit an offer.
2.2 By submitting a booking request (via email, WhatsApp, or contact form), the Tenant makes a binding offer. The rental agreement is only concluded upon written confirmation (including by email) by the Landlord.
2.3 The Tenant must be at least 18 years of age.
3. Prices and Payment
3.1 Rental prices include statutory VAT and final cleaning, unless otherwise stated.
3.2 In addition, a local tax (Ortstaxe) is charged per person per night in accordance with the Tyrolean Tourism Tax Act. The current amount will be communicated upon booking confirmation.
3.3 A deposit of 30% of the total rental price is due within 7 days of the booking confirmation. The remaining balance must be paid no later than 14 days before arrival.
3.4 For short-notice bookings (less than 14 days before arrival), the full amount is due immediately.
3.5 Payments are made by bank transfer to the account specified in the booking confirmation.
4. Arrival and Departure
4.1 Check-in: from 3:00 PM on the day of arrival.
4.2 Check-out: by 10:00 AM at the latest on the day of departure. The apartment must be left in a tidy condition.
4.3 Different times may be arranged by prior agreement.
5. Cancellation
5.1 Free cancellation is possible up to 30 days before the agreed arrival date.
5.2 For later cancellations, the following fees apply:
- 30 to 15 days before arrival: 50% of the total rental price
- 14 to 1 day before arrival: 80% of the total rental price
- On the day of arrival or no-show: 100% of the total rental price
5.3 The Tenant is free to provide evidence that the Landlord incurred no damage or significantly less damage.
5.4 We recommend purchasing travel cancellation insurance.
6. Occupancy and Use
6.1 The maximum occupancy is specified in the booking confirmation. Exceeding the maximum occupancy is not permitted.
6.2 The Tenant undertakes to treat the vacation apartment with care and to observe the house rules.
6.3 Smoking is not permitted anywhere in the vacation apartment. In case of violation, a cleaning fee of EUR 250 will be charged.
6.4 Pets are only permitted by prior arrangement and subject to a surcharge.
7. Liability and Deposit
7.1 The Landlord is not liable for loss or damage to the Tenant's property, to the extent permitted by law.
7.2 The Tenant is liable for all damage caused by themselves, their companions, or visitors to the vacation apartment.
7.3 A security deposit of EUR 300 may be required upon arrival. The refund is made after inspection of the apartment upon departure.
8. Defects and Complaints
8.1 Defects must be reported to the Landlord immediately so that remedial action can be taken.
8.2 If the Tenant fails to report defects in a timely manner, claims regarding the unreported defect shall be forfeited, provided the Landlord could have remedied the situation if notified in time.
9. Registration Obligation
In accordance with the Austrian Registration Act, all guests are required to present a valid official photo ID upon arrival. The data will be recorded on the registration form.
10. Force Majeure
In cases of force majeure (e.g., natural disasters, pandemics, official orders), both contracting parties are released from their obligations. Payments already made will be refunded in full.
11. Applicable Law and Jurisdiction
11.1 Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
11.2 Jurisdiction: the competent court in Schwaz, Austria (for businesses). For consumers, the statutory provisions apply.
12. Final Provisions
12.1 Should individual provisions of these GTC be invalid, this shall not affect the validity of the remaining provisions.
12.2 Amendments and additions must be made in writing.
